What is Prohibited Contribution?

Any business required to register with the State Board of Elections because it has contracts with the State of Illinois aggregating in excess of $50,000 annually is prohibited from contributing to any political committee supporting the candidacy of the officeholder* responsible for awarding the contracts or any other declared candidate** for that office. This prohibition includes not only the business, but also any of its affiliated persons or entities***, and shall be in effect for the term of office of the incumbent officeholder awarding the contracts or for two years following the expiration or termination of the contracts, whichever is longer.

Any business required to register with the State Board of Elections because it either has bids or proposals exceeding the $50,000 threshold or a combination of bids or proposals in addition to contracts exceeding the $50,000 threshold, is prohibited from contributing to any political committee supporting the candidacy of the officeholder responsible for awarding the contract on which the business has submitted a bid or a candidate(s) seeking that office. This prohibition also includes any of the business’ affiliated persons or entities and shall be in effect from the date the invitation for bids or request for proposals is issued and ending on the day after the contract is awarded.

The Business Registration page of the State Board of Elections’ website includes a searchable database listing all contributions made by businesses and their affiliated persons or entities to any political committee filing electronically with the Board. Any contribution made prior to January 1, 2009, the effective date of the Act, is not included in this database. The Board will not make any determination as to whether a contribution is legal or whether it is prohibited by this Act, as it lacks specific authority to do so.

This site also has a link to the searchable database maintained by the Comptroller’s office which provides the capability to search by business entity name to determine what contracts it has or has had with the State of Illinois.

The State Board of Elections currently does not have access to information that separates those businesses that have existing State contracts and those that have submitted bids or proposals on State contracts (or that have a combination of the two). That information can only be obtained at the procurement office of the agency that awarded the contract or solicited the bid or proposal for contract.



*“Officeholder” means the Governor, Lieutenant Governor, Attorney General, Secretary of State, Comptroller, or Treasurer. The Governor shall be considered the officeholder responsible for awarding all contracts by all officers and employees of, and vendors and others doing business with, executive branch State agencies under the jurisdiction of the Executive Ethics Commission and not within the jurisdiction of the Attorney General, the Secretary of State, the Comptroller, or the Treasurer.

**“Declared candidate” means a person who has filed a statement of candidacy and petition for nomination or election in the principal office of the State Board of Elections.

***“Affiliated person” means (i) any person with any ownership interest or distributive share of the bidding or contracting business entity in excess of 7.5%, (ii) executive employees of the bidding or contracting business entity, and (iii) the spouse of any such persons.”

***“Affiliated entity” means (i) any subsidiary of the bidding or contracting business entity, (ii) any member of the same unitary business group, (iii) any organization recognized by the United States Internal Revenue Service as a tax-exempt organization described in Section 501(c) of the Internal Revenue Code of 1986 (or any successor provision of federal tax law) established by the bidding or contracting business entity, any affiliated entity of that business entity, or any affiliated person of that business entity, or (iv) any political committee for which the bidding or contracting business entity, or any 501(c) organization described in item (iii) related to the business entity, is the sponsoring entity.
